Daboseong Gallery Membership Terms and Conditions

Article 1 [Purpose] The purpose of this Agreement is to prescribe matters concerning the rights, duties, responsibilities, and procedures for the use of services between the company and its members through the Internet homepage (hereinafter referred to as the "home page") provided by Davoseong Gallery (hereinafter referred to as the "Company"). An act of providing an online transaction by a company so that the trade of goods can be made between the members according to their respective decisions.


Article 2 [Expressing, Effective, and Altering Terms] ① The company shall post these terms and conditions on the initialization page of the website (http://www.daboseong.com) for service users and members to access them.
② The company shall specify the date of application of the amended terms and conditions at the time of the amendment and notify them by the method referred to in paragraph ① seven days prior to the application. Provided, That the modification of the contents of the terms and conditions unfavorable to the members shall be announced with a grace period of at least 30 days in advance. The amended terms and conditions shall not apply retrospectively before the date of application.


Article 3 [Relationship to relevant statutes] ① Matters not prescribed in these terms and conditions shall be governed by the provisions of the relevant statutes, such as the Telecommunications Business Act, the Framework Act on Electronic Trade, the Promotion of Information and Communication Network Utilization, and the Protection of Information.
② When using services provided by the company, the member shall comply with the relevant statutes, such as the Visit Sales Act, the Framework Act on Electronic Trade, the Consumer Protection Act, the Fairness of Display Advertisements, and the Act on the Promotion of Information and Communication Network Use and Information Protection. No claim shall be made for immunity from violation of the relevant statutes, citing the provisions of these Terms.


Article 4 [Defines of terms] The terms used in these terms and conditions are defined as follows:
① 'Homepage' refers to the online system http://www.daboseong.com established and operated by the company.
② Member refers to a person who approves these terms and conditions and enters into a service use contract with the company.
③ ID refers to letters and numbers established by members and approved by the company for the identification and service of members.
④ 'PASSWORD' refers to a combination of letters and numbers established by a member and approved by the company for identification of members' identity and protection of member information.
⑤ Exhibition refers to an event in which a company posts and sells goods on its website.
⑥ 'Auction' refers to an event in which a member who offers a high price for an item posted by a company purchases it.
⑦ The term "consignee" means a member who has completed a prescribed form and registered it online to sell goods through auction by the company.
⑧ 'Buyer' refers to a member who has won an auction.
⑨ 'Bidding' refers to the act of a member submitting the price of the item in order to purchase the auction item, and the principal of the act is referred to as 'bidders'.
⑩ 'The winning bid' refers to the establishment of a transaction of an auction item by bidding, and the principal of the act is referred to as 'a bidder'.
⑪ 'General auction' refers to the auction method that is sold to the highest bidder among bidders. Other. 'Immediate purchase' refers to the method of auction in which the seller makes an immediate bid for the immediate purchase price indicated by the seller.
⑫ "My Page" refers to a service screen on which a company provides information on members, sales, purchases, bids, etc. on this website so that members can use auction services quickly and conveniently.


Article 5 [Service Use Contract] ① A contract for the use of services provided by the company (hereinafter referred to as "use contract") shall be established by the company's consent to a person's application for use (application for membership) of the person who intends to use the service. The company shall post the intention to accept the use on the relevant service screen or notify the applicant by e-mail or other means.
② Individuals or businesses aged 14 or older can sign up for membership. An applicant for use shall apply for a subscription under his/her real name, and a member who is not his/her real name or who has stolen information from others shall not use the service provided by the company.
③ When a minor joins a member, he/she shall join after obtaining consent from his/her legal representative.
④ In principle, only one ID (ID) can be used per person with real name, and a service contract shall be concluded by ID.


Article 6 [Application for use] ① A person who intends to use the service shall record the following matters in accordance with the application for registration provided online by the company: Matters to be entered in the application for membership shall be classified according to whether the applicant is an individual or a business operator.
A. Required items for individual members include name, gender, ID, password, date of birth, address, mobile phone number, e-mail, etc.
B. Required items for corporate members include ID, password, business name, CEO name, business registration number, business address, business address, phone number of person in charge, and representative e-mail.
② Individual business operators or corporations shall apply for membership as business membership membership membership membership membership, and shall provide additional information and evidence such as business registration certificates requested by the company.
③ In addition to the required items in paragraph ② above, the company may request the applicant to provide various and informative information such as occupation, work name, work address, work phone number, hobbies, interests, and other information. Article 7 [Approval of an application for use] ① In principle, the company shall enter the required items prescribed in Article 6 accurately and, if the applicant agrees to this Agreement, accept the service use through the real name verification procedure under this Agreement.
② In the case of an application for personal membership, the company shall go through the real name verification process through a credit information company or a credit information concentration institution, and in the case of an application for business membership, the real name verification process shall be carried out according to Article 6. The company may request the applicant to provide evidentiary materials for an application for use that is unable to take the procedure for verifying the real name.
③ The company may refuse to accept the application for use in the following cases:
a. Where a minor files an application for use without the consent of his/her legal representative;
b. Where it is confirmed that the company's real name verification procedure is not an application for real name registration;
c. If the name and mobile phone number (or business registration number) are the same as the member already subscribed;
d. Where a former member whose contract for use has been terminated by the company pursuant to Article 9 of this Agreement applies for re-use;
e. Where a member who has been suspended from membership pursuant to Article 12 of this Agreement voluntarily terminates the service contract and reapplies for re-use during the suspension of use;
f. In case false information is entered in the required list item to be entered when applying for membership;
g. Where other illegal or unjust applications for use have been confirmed;
h. The company may withhold its acceptance of the application for use in the following cases: In such cases, the company shall post on the service screen or notify the applicant of the reason for the reservation, when it can accept it, or other matters related to the reservation of consent, such as information or data for additional requests necessary for approval.
(1) There is no room for facilities related to the provision of services;
(2) In case of technical difficulties or disabilities;
(3) In case real name registration of the company is not confirmed in the real name verification procedure
(4) Where a person who has applied for a business registration does not provide evidence or additional information under Article 6(d);
(5) Where the other company deems it necessary by reasonable judgment;


Article 8 [End of Service Contract] ① A member or company may terminate the service contract in accordance with the procedures set out in this Agreement.
② Termination of members
A. A member may terminate the service contract at any time by notifying his intention to terminate it. However, the member shall complete, withdraw, or cancel all ongoing auction procedures before notifying his intention to terminate. In such cases, the member himself/herself shall bear the disadvantages caused by the withdrawal or cancellation of the auction.
B. The service contract shall be terminated when the termination intention of the member reaches the company.
C. A member who has been terminated pursuant to this paragraph may rejoin as a member in accordance with the membership registration procedures and the relevant provisions prescribed by this Agreement.
③ Termination of the company
A. The company may terminate the service contract in the following cases: In such cases, the company shall notify the member of his intention to terminate the cancellation by e-mail, telephone, or faxing. However, the company may grant the relevant member an opportunity to state his/her opinion on the grounds for dismissal in advance.
(1) Where it is confirmed that a member has a reason for refusing to accept the use contract prescribed in paragraph (2) of Article 9;
(2) Where a member conducts or attempts to trade goods in violation of the customs or other public order;
(3) Where a member violates the rights, honor, credit or other legitimate interests of the company or other members;
(4) Where a member acts or attempts to obstruct the smooth progress of services provided by the company;
(5) Where any other member commits an act in violation of these terms and conditions;
B. The service contract shall be terminated when the termination doctor of the company reaches the member, but if the company is unable to notify the termination intention due to an error in the contact information provided by the member, the contract shall be terminated when the company notifies the termination intention on My Page.
C. If the company terminates the service contract, the company may cancel or forcefully terminate the auction related to the member without notice.
D. The member who has completed the service contract shall bear the responsibility for any damages incurred in connection with the termination of the service contract, and the company shall not be held responsible for any damages.


Article 9 [Collection and Protection of Member Information] ① In addition to the information provided by the member for the use contract, the company may collect necessary information from the member by revealing the purpose of collection or use. In such cases, the company shall obtain consent from the members to collect information.
② When the company obtains consent from the members for information collection, it shall specify or notify the purpose of collecting information, the purpose of use, and the information related to the third party (the recipient, the purpose of providing information). The member may withdraw his/her consent even if he/she agrees to provide information.
③ The member shall provide the company with the information as it is.
④ Except for information disclosed through the service screen such as ID, the company shall not use the information collected by the company for any purpose other than collection, use, smooth service, and expansion of the service, or provide it to a third party without the consent of the member. However, exceptions shall be given to the provision of minimum member information (name, address, phone number, etc.) for delivery to the commodity delivery company when the relevant laws are otherwise prescribed.
⑤ Members may access information about them at any time and request the company or the information management manager to correct the wrong information. The company shall not use the information requested by the member for correction until the error is corrected.
⑥ For the protection of member information, the company shall limit the manager to a minimum, and if the member information is lost, stolen, leaked, or tampered with due to the company's intention or negligence, he/she shall bear all responsibility for the damage to the member.
⑦ In principle, when the contract for use is terminated, the company shall destroy the information of the relevant member. Provided, That in the following cases, member information shall be kept, but shall be used only for the purpose of storage:
A. Where it is necessary to preserve in accordance with the provisions of the relevant statutes, such as the Commercial Act, the Act on Consumer Protection in e-commerce, etc., the company shall keep the member information for a certain period prescribed by the relevant statutes.
B. For the purpose of protecting members and the company from other Internet frauds and cooperating with investigations according to legal procedures, the company keeps minimum information such as ID, nickname, name or name, contact information, address, termination, and suspension of membership for two months after the contract ends.
C. If a member has an outstanding payment to the company, he/she shall keep the minimum necessary information, such as his/her ID, name, name, name, contact information, address, etc. until the collection is completed.
D. Where the retention period is specified when obtaining consent for the collection of other information, member information shall be kept until the retention period.
⑧ The company shall disclose its personal information policy on the protection and management of member information on its website (http://www.daboseong.com) so that members and those who wish to use the company's services can know.


Article 10 [Change of Member Information] ① The member shall immediately correct the matters stated in the application for use if they are incorrect or changed. Provided, That in principle, the business registration number shall not be modified in the case of an ID, name, or corporate business entity. The member shall immediately provide evidence of the amendment if requested by the company.
② The member shall bear various damages caused by the failure to modify the relevant information even though the member's information has been changed, and the company shall not be liable for any damages caused by the wrong modification.


Article 11 [Management of IDs] ① The member shall be responsible for the management of IDs and passwords, and the member shall not transfer or lend IDs and passwords to others.
② The company shall not be liable for any loss or damage caused by the leakage, transfer, or loan of IDs or passwords that are not attributable to the company.
③ If a member recognizes that his ID or password is stolen or used by a third party, he/she shall immediately notify the company, and if there is a company's guidance, he/she shall comply therewith.


Article 12 [Suspension of membership] ① For the stability and reliability of transactions through auction services, the company may suspend membership in certain cases, restrict the use of auction services, or take other necessary measures. If the company suspends its membership, restricts the use of auction services, or takes necessary measures, the company may notify the members by wire, e-mail, or other means, and may notify the members after taking necessary measures, such as in case of an emergency. Members whose membership has been suspended cannot use the auction service.
② Suspension of membership, etc.
A. Refusal to sell: The sale of the goods shall not be refused after the consignee has won the bid.
B. Refuse to purchase: The winning work cannot be canceled unless there is a problem with the work.
C. In cases of the above subparagraphs and subparagraphs, the company may suspend or permanently suspend the qualification of the relevant member.
③ The company may suspend membership for unfair bidding and illegal card transaction activities that interfere with the auction process, such as false bidding and bid manipulation.
④ If there is an incomplete auction for a member whose membership has been suspended, the member shall complete all the processes related to the auction.


Article 13 [Type and Use of Services] Services provided by the company include exhibitions and auctions. The type and content of these services are subject to change.
① The company shall announce the characteristics, procedures, and methods of each service through the service screen. The members shall fully understand the matters concerning the services announced by the company in advance and use the services.
② Members can access the services provided by the company through ID, password, or mobile phone authentication, and participate in the consignment or purchase of goods using the service.


Article 14 [Purchase Exhibition] ① Members may purchase items displayed on the website from the relevant service screen.
② Purchase method
A. The member shall carefully purchase the product after examining the product registration information.
B. For the purchase, the purchase price for the requested item must be deposited into the company's account before the contract can be completed.
C. Information about purchased items can be found in the buyer's email or My Page screen.
D. In principle, purchased goods are directly received by purchasing members, and the company can arrange delivery companies on the premise of the responsibility and burden of purchasing members.
E. When a purchasing member requests the delivery of goods, he/she shall notify the company of the address changed to wired or e-mail if the address of the place of receipt of goods is different from that specified at the time of membership.


Article 15 [Auction Bidding] ① A member who intends to purchase goods shall bid on the service screen provided by the company.
② Bidding method
A. A member shall examine the information on the registration of goods in detail and bid carefully only when he/she intends to purchase them.
B. You can bid several times until the designated deadline, but it is impossible to cancel.
C. Bidding methods include bidding (currently bidding) and automatic bidding.
D. All works may be automatically submitted before the deadline. Automatic bidding is a method in which if there is a competition, the amount entered is automatically bid according to the unit of the arc.
③ Purchase process
A. The buyer can check the success of the bid on the My Page screen or the winning bid confirmation mail sent by the company within 24 hours after the auction is over.
B. Auctions with an immediate purchase price will be auctioned off if you bid at the immediate purchase price before the auction period expires.
C. In principle, purchased goods are directly received by the purchaser, and the company may arrange the delivery company on the condition of the buyer's responsibility and burden.
D. When delivering goods at the request of a buyer, the buyer shall notify the company of the address changed to wired or e-mail if the address of the place of receipt of goods is different from that specified at the time of membership.


Article 16 [Exemption of the Company] ① If the company is unable to provide services temporarily or eventually due to force majeure, repair inspection of information and communication facilities, failure of replacement, or loss of communication, the responsibility for providing services shall be exempted. In such cases, the company shall notify the members in the manner prescribed in Article 2 of the Terms and Conditions.
② The company shall not be responsible for any obstruction in the use of the service due to reasons attributable to Internet users or members.
③ The company shall not be liable for damages caused by defects in goods traded through auction services, errors in commodity registration information, or insufficiency, unless proven to be based on reasons attributable to the company.
④ The auction item will be displayed in the company's exhibition hall before the auction, so the bidder must directly examine and confirm the item before bidding. The company guarantees the status of the auction item "as it is" at the time of the auction, and the company shall not be responsible for the status of the auction item that the buyer has not confirmed at the time of the auction.
⑤ The company shall not be liable for damages caused by trusting the accuracy of information, data, facts, etc. posted by other members.
⑥ The company and the connected company (the company that operates the website connected to the company's service screen and link) are independently operated, and the company is not responsible for the transactions between the connected company and its members.


Article 17 [Compliance Act and Jurisdiction Court] These terms and conditions shall apply to the laws of the Republic of Korea, and where a lawsuit is filed against the interpretation of these terms and disputes arising between the company and its members, the competent court shall be governed by the statutes of the Republic of Korea.


Article 18 [Other Clauses] ① The company shall establish and operate a customer center to reflect legitimate opinions or complaints raised by members and to resolve such problems and to mediate disputes between members. The company shall promptly deal with complaints and opinions raised by members if deemed justified, and shall, where it is impracticable to handle them immediately, notify the grounds therefor and the period of processing thereof.

Attachment Article 1 [Application date] These terms and conditions shall apply from 1 October 2020.

Article 2 [Transitional Regulations on the Change of Type of Membership] Where a member who subscribes before the application date of this Agreement intends to use the company's services, he/she shall undergo the real-name authentication process using a mobile phone.
